How to pay your employees?

There are several regulations governing employee compensation. Generally speaking, the principle is based on a relationship of trust between employer and employee. Find out how to pay your employees.

Mandatory criteria

First of all, the employer is obliged to pay his employees the amount agreed upon in writing in the clauses of the employment contract. Failure to comply with this rule without legal justification will result in legal sanctions. Secondly, when the employer pays his employees, he must take into account the overtime and bonuses promised by his company, according to the existing collective agreement. Also, according to the collective agreement, the employer can pay the employee an annual bonus of a sum decided by the employer or of the sum written in the contract on annual bonuses.

What is the period for paying employees?

The employer cannot pay his employees as he wishes. He must respect certain rules of periodicity of the salary. The date of payment is not imposed on the employer. Thus, he can choose to pay his employees at the beginning, during or at the end of a month, provided that the period between two dates of payment of an employee's salary does not strictly exceed one month. However, there are some exceptions. Companies or collective agreements may, in some cases, agree to a system of compensatory rest. On the other hand, in the case of a temporary employee, the salary must be paid in two instalments and the time interval between two payments may not exceed 16 days. After a few months of work, the employee can also ask his employer for an advance on his salary. However, the amount of this advance payment cannot exceed half of the monthly salary received by the employee.

Which means of payment should I choose?

As for the method of payment, both parties must first agree before the employer goes to pay his employees. The payment can be made either by bank transfer, cash or check. The employer must then respect the employee's choice of payment method. More precisely, he is obliged to pay his employees in accordance with their request. In the event that the employee is under 18 years of age, his parents or legal guardian are entitled to claim his salary and to request the means of payment that is most convenient for them.
